The Canadian Institute is organizing a conference on the effective management of insurance litigation, to be held on December 10 and 11, 2007 at the Hotel Omni Mont-Royal. As guest lecturer, Me François Beauchamp, who is in charge of our Insurance Group, will provide an overview of recent judicial developments and the scope of an insurer's obligation to defend.
His lecture will focus on the following subjects:
- Analyzing recent judicial developments with respect to an insurer's obligation to defend, in order to determine the new rights and obligations of the parties as well as the solutions proposed by the courts;
- Determining the portion of the costs of a defence assumed by an insured in order to avoid litigation on the matter;
- Avoiding conflicts of interest in an insurer's obligation to defend so as to prevent litigation;
- Is the obligation to defend limited to paying the amount of the coverage limit?
- To what extent can it be said that the obligation to defend is broader than the obligation to indemnify?
