DGC Conference in Business Law - Transferring your business: Risks and challenges
Marriot Chateau Champlain Hotel, Montréal, November 14, 2006

Through four presentations of approximately thirty minutes each, we’ll highlight some of the economic and legal aspects arising from the transmission of businesses. Particularly vulnerable upon their transfer are family businesses - those controlled by one or more families. Indeed a significant number of them do not survive the departure of their founder and principal shareholder. In Quebec, approximately 68% of all businesses are family businesses, and it is expected that more than half of the directors currently heading them will retire within the next five to ten years.

Every transaction involving the transfer of a business brings many factors into play and gives rise to risks and challenges. The Business law professionals at De Grandpré Chait LLP have frequently played a leading role in several transactions of inter-generational transfers, the purchases and sales of businesses, acquisitions by employees (Management buy-outs) and employees’ profit-sharing. We have the know-how and expertise to manage the complex legal, commercial and tax issues arising from such transactions.
